Notarial fees

The notary is entitled to a fee and cost reimbursement specified by law [22/2018. (VIII. 23.) IM decree] for their activities, which must be paid by the initiating party – or the interested party in the case of ex officio proceedings. In the case of multiple parties, the payment obligation is joint and several.

Calculation of Notary Fees

Fee Based on Transaction Value: If the value of the subject of the notarial activity (e.g., a loan agreement of 5,000,000 HUF, secured by an independent lien of 6,500,000 HUF) can be determined, the notary fee must be established based on the higher value. The value of recurring services (e.g., lease agreements, tenant commitments) must be determined based on the value of the service or right. If such a contract is concluded for an indefinite period, three times the annual value is the basis.

Fee Based on Time Spent: If the value of the subject of the notarial activity (transaction value) cannot be determined, the fee must be established based on the time spent on the notarial activity, which includes the time required for preparation, execution, and any necessary travel. The fee for the time spent on the procedure is 5,500 HUF for every started hour [IM decree 13. §], which can be multiplied based on the law.

A higher fee may be charged if the notary performs the work outside working hours or not in the office but at a location specified by the client, or if a record is made of the preservation of the document (e.g., deposit of a will), or if the notary certifies a legally significant fact (e.g., certifying website content) or records a legal declaration in a document.

Other Fees:

The fee for authenticating copies, extracts, and excerpts of documents is 750 HUF per page [IM decree 33. §], in addition, the notary must be paid an amount equal to 40% of the fee as a cost reimbursement [18. §], and a transcription fee of 150 HUF per page [17. §].

For certifying the authenticity of a signature and company registration, a fee of 3,000 HUF per signature must be paid [29. §], in addition, the notary must be paid an amount equal to 40% of the fee as a cost reimbursement [18. §], and a transcription fee of 150 HUF per page [17. §].

For trust custody, half of the fee based on the transaction value is due. The fee for the preservation of a will or other document and trust custody includes the fee for the first 12 months of custody; if the custody period exceeds this, double the aforementioned fee is due.

In addition to the fee, the notary is entitled to cost reimbursement, which is 40% of the given fee and the out-of-pocket expenses.

Section 6: The fee under this decree – excluding the portion based on Section 14 – b) must be charged at double the rate if the notary bc) prepares the document or certificate in a foreign language at the request of the party.
